These General Terms and Conditions of Sale (GTC) govern the relationship between La Tribu and any person making a reservation or purchasing our services. We invite you to read these terms carefully before making a booking. By making a reservation, you unreservedly accept the terms of these GTC.

2. Liability and Mandatory Documents
All participants in stays, cruises, and kitesurfing activities offered by La Tribu must, prior to the start of any activities :
complete a registration form,
sign a liability waiver.
For minor participants, these documents must be signed by their legal guardians.
All participants in cruises and kitesurfing activities acknowledge that they are engaging in a high-risk sporting activity and agree to comply with the safety instructions provided by the La Tribu team.
La Tribu reserves the right to refuse or terminate the participation of any individual whose behavior or physical condition may pose a danger to themselves or to others.
3. Cancellation – Modification – Force Majeure
3.1 Cancellation Conditions – “Villa + Cruise” Stays
3.1.1 Cancellation by the Client
Any cancellation must be notified in writing (by email or contact form). The date of receipt of the request shall be considered the official date.
The following cancellation fees apply (based on the total amount including taxes of the booking) :
Up to 65 days before departure (inclusive, D‑65) : 100% refund
Between D‑64 and D‑46 inclusive : 50% refund
From D‑45 inclusive : No refund
These fees correspond to the fixed costs and expenses incurred by La Tribu (reservations, private bookings, logistics, service providers, organization) as well as the inability to resell the stay within a reasonable timeframe.
It is strongly recommended that the Client take out travel insurance that includes a cancellation coverage.
Clients are responsible for checking with the embassy of their country of origin, prior to their arrival, regarding visa requirements as well as any COVID‑19 or quarantine restrictions. La Tribu is not responsible for any cancellation fees resulting from failed or delayed visa applications.

3.1.2 Replacement of the Participant
Up to 7 days before departure (D‑7), the Client may request the transfer of their booking to a third party, subject to :
that the replacement meets the participation requirements
and that La Tribu confirms the logistical feasibility
Reasonable administrative fees may be applied.
3.2 Cancellation Conditions – Kitesurf Lessons Only
All kitesurf lesson bookings automatically include equipment rental.
3.2.1 Cancellation Before the Start of Lessons
Serious medical reason : upon presentation of a medical certificate, La Tribu will offer the following options :
a credit valid for 12 months
or a refund, minus any costs already incurred
Other personal reasons : no refund is guaranteed. A rescheduling may be offered subject to availability, at the company’s discretion.
3.2.2 Cancellation or Interruption During the Stay
Weather conditions (lack of wind) : La Tribu will offer a rescheduling, a pedagogical adjustment, or, if not possible, a pro-rata refund for the hours not completed, only if the lessons could not be rescheduled.
Injury : a pro-rata refund for the lessons not attended upon presentation of a medical certificate.
Other reasons : no refund.
3.3 Modification or Cancellation by La Tribu
For reasons of safety, weather, logistics, or supplier availability, La Tribu may modify the organization of the stay without entitling the Client to a refund, provided that the main service is still ensured.
In the event of a complete cancellation of the stay by La Tribu before departure, the Client may choose between :
full refund
rescheduling to a later date
a credit valid for 12 months
3.4 Force Majeure
A force majeure event is any unforeseeable, irresistible, and external occurrence that makes the execution of the contract impossible (natural disaster, administrative decision, border closure, armed conflict, epidemic, major government restrictions).
In such cases, La Tribu will offer a rescheduling, a credit, or a full or partial refund depending on the level of contract fulfillment and the non-recoverable costs incurred.
4. Itineraries and Changes
Cruise and stay itineraries may be modified due to weather or logistical conditions. The trip coordinator and the captain are the sole decision-makers to ensure the safety of people and property. La Tribu reserves the right to change the boat if necessary (e.g., damage, number of participants). An equivalent or compensatory service will be offered.
4.1 Boat Changes
La Tribu may change the boat in the following cases, without this list being exhaustive :
number of participants not in accordance with the booking conditions (either lower or higher)
damage, breakdown, or technical unavailability of the boat
safety or logistical requirements
The service offered on the new boat will be equivalent. If this is not possible, a compensatory solution will be offered to the client, without entitling them to a full refund.
4.2 Price Changes
La Tribu reserves the right to revise its prices in the event of economic, political, or regulatory impacts beyond its control, including :
significant fluctuations in exchange rates
increases in fuel costs
increases in port fees, taxes, or charges imposed by authorities
If these impacts result in a substantial change in price, La Tribu will notify the affected clients at least 14 days before the new rate takes effect, which will be payable by the client.
If a price impact occurs less than 28 days before the start of the stayit will not be charged to the client.
5. Health and Emergencies
5.1 Medical
Each participant confirms :
not have any illness or infection that could pose a risk to themselves or to other participants,
not have consumed alcohol or drugs before each kitesurfing session.
La Tribu reserves the right to prohibit any participant from kitesurfing if they pose a danger to themselves or to others.
5.2 Emergency
You agree to cover all costs related to medical treatment, recovery, and transport in the event of an accident.
If you are unable to make decisions for yourself, you authorize La Tribu and its representatives to approve medical treatment or ensure that necessary care is provided by a medical team on your behalf.
You will provide La Tribu with your insurance company’s contact details, your policy number, and the phone numbers of the persons to contact in case of a medical emergency.
6. Safety and Marine Life
6.1 Boat Safety
You agree to comply with, or ensure compliance with, the safety standards on board the boat or during navigation. These standards will be communicated to you before or during the stay.
Kitesurfing and boat navigation involve high risks. You must follow safety instructions and inform any crew member if you identify a danger to yourself or others.
You will not hold La Tribu responsible for any damages resulting from the normal risks of navigation.
You understand and accept the risks associated with practicing kitesurfing without any possible recourse against La Tribu, and you waive any legal action in the event of injury, serious injury, or death occurring during the stay.
6.2 Marine Life and Liability
You are informed that in the sea there is marine and underwater life that may represent a risk or danger to your safety.
You release La Tribu from any liability in the event of an attack originating from marine or underwater life, whether fatal or non-fatal (for example, a shark attack).
7. Equipment
La Tribu offers kitesurfing equipment for rent (kite, bar, board, foil, mask, snorkel, fins), which is regularly maintained or replaced. However, no guarantee is given regarding its construction or its safe use.
Participants using this equipment do so under their sole responsibility and at their own risk..
You must inspect the equipment before use and refrain from using it if it shows any defects or poses a risk to your safety. You are required to ensure that the rented or loaned equipment is in proper working condition and free from defects.
You agree to return the equipment at the end of the rental period in the same condition, subject to normal wear and tear.
You will be responsible for any loss, breakage, or damage caused to the rented or loaned equipment, and you undertake to reimburse the cost of any damaged or stolen equipment (an inventory and condition report will be carried out prior to rental or loan).
You will not hold La Tribu liable for any injury or damage caused by the rented or loaned equipment and waive any legal action in this regard.
8. Insurance
La Tribu est une société de droit égyptien, mais est soumise à la législation du pays où se déroule l’activité de kitesurf.
Each client must provide adequate personal insurance, covering kitesurfing and related activities in order to protect themselves against all risks associated with these activities.
It is your responsibility to ensure that your insurance provides sufficient coverage and that you practice kitesurfing within the limits of that coverage.
We also recommend taking out travel insurance covering accidents, such as :

Kitesurfing civil liability insurance (CL)
Kitesurfing repatriation assistance insurance (RA)
Personal accident coverage for participants (PA)
9. Jurisdiction
All kiters must present a valid kitesurfing certification or qualification and sign a fully completed registration and waiver form before beginning any activities.
